The Freedom of Information (Scotland) Act 2002 (FOISA) provides individuals with a right to access to all recorded information held by public authorities in Scotland. Anyone can use this right, and information can only be withheld where permitted by FOISA.
The Act also lays down that all Scottish public authorities should have a publication scheme. The publication scheme describes the types of information that the public authority will routinely make available; and it has to be reviewed from time to time.
Every Publication Scheme, or Model Publication Scheme, has to be approved by the Scottish Information Commissioner, who is responsible for enforcing FOISA.
The publication scheme also provides details of how to access the information available and tells you if it is free or if there is a charge. It gives you the contact details for requesting information not available automatically through the publication scheme.
Both the publication scheme and the individual request route also cover information which is accessible under the Environmental Information (Scotland) Regulations 2004 (EIRS).
